By engaging the mooring services provided by Manchester Mooring Service (“the Company”), you (“the Customer”) acknowledge and agree to the following terms and conditions:

1. Assumption of Risk
   Mooring a vessel involves inherent risks, including but not limited to, damage due to weather, tidal forces, equipment failure, or third-party actions. The Customer accepts full responsibility for these risks.
    

2. Limitation of Liability
   The Company will take reasonable precautions to maintain mooring systems in proper working order. However, the Company shall not be held liable for:
    

   • Any damage to vessels, equipment, or personal property;
      

   • Loss of use or consequential damages;
      

   • Injury or death resulting from use of the mooring or related services.
      

3. Inspection and Maintenance
   The Customer is responsible for conducting regular inspections of their vessel and associated mooring lines. The Company provides annual inspections and maintenance of the mooring system only, not the vessel itself.
    

4. Adverse Weather
   During extreme weather conditions (e.g., storms, hurricanes, etc.), the Company cannot guarantee the safety of any moored vessel. It is the Customer’s responsibility to take additional precautions or arrange for vessel relocation when severe weather is forecasted.
    

5. Release of Claims
   By using our mooring services, the Customer hereby releases and discharges Manchester Mooring Service, its employees, contractors, and agents from any and all claims, demands, or causes of action arising from or connected with the use of our mooring services.
    

6. Insurance
   The Customer is encouraged to carry adequate marine insurance covering potential loss or damage while the vessel is moored.
    

7. Compliance with Laws
   The Customer is responsible for ensuring that their vessel complies with all applicable maritime and environmental laws and regulations while using the Company’s mooring services.
